Child Marriage in Malaysia
In Malaysia, at least 1,500 children are married every year, across all states and throughout all ethnic and religious communities. Both boys and girls are affected by child marriage but the impact on girls is greater as they are more vulnerable to domestic violence. Detailed data on the number of child marriages across time, region and ethnic groups are not easily available. According to the Department of Syariah Judiciary Malaysia, Sarawak has the highest numbers of Muslim child marriage applications in Malaysia. The numbers would be much higher if non-Muslim and unreported child marriages are included.
In 2018, Kedah and Selangor amended the minimum legal marriage age by raising it to 18 for both men and women. In 2019, the Sarawak State government showed full support on the proposal on addressing child marriage. However, Sarawak has yet to increase the legal marriage age for all to 18 years old for both men and women. For Sarawak’s Syariah law, the legal age for marriage is 18 years old for men and 16 years old for girls but a Syariah Judge is given the power to permit marriage for those younger than 18 and 16 respectively. However, there are no rules put in place for customary marriages.
SWWS’ Petition to Ban Child Marriage in Sarawak
During SWWS’ #bukansalahkamek exhibition at Old Court House (15 October – 31 October 2022), we started gathering signatures for our petition to call on the government to ban child marriages in Sarawak. We continued to collect petition signatures in 2023, particularly during the Weekend Eco Market at Dewan MBKS (29 April – 30 April 2023) where SWWS held a booth there.
To-date, SWWS collected a total of 734 signatures for our petition to ban child marriage in Sarawak.
Petition Signatures Handover for Sarawak DUN sitting in May 2023
On 12th May 2023, SWWS handed over our petition signatures to ban child marriage in Sarawak to Pending assemblywoman YB Violet Yong. SWWS thanks YB Violet Yong for supporting our petition and for raising the issue on child marriage in DUN Sarawak assembly on 17th May 2023.
Our Petition Demands
We request the Dewan Undangan Negeri Sarawak to call, through resolutions of this Dewan that:
- the State Government present a bill before the Dewan by July 2023 to amend the Islamic Family Law Ordinance, 2001 to increase the minimum age of marriage for girls from 16 to 18 and to remove all exceptions that permit under-age marriage;
- the Sarawak Native Customs Council (MAIS) must obtain the consent from all community leaders to increase the minimum marriage age to 18 by July 2023;
- a Special Select Committee of this Dewan be formed to inquire into and report on the policies, implementation, prevalence, causal factors and solutions to child marriage in Sarawak.
- the State Government present a bill before the Dewan by July 2023 to amend the Islamic Family Law Ordinance, 2001 to increase the minimum age of marriage for girls from 16 to 18 and to remove all exceptions that permit under-age marriage;
- the Sarawak Native Customs Council (MAIS) must obtain the consent from all community leaders to increase the minimum marriage age to 18 by July 2023;
- a Special Select Committee of this Dewan be formed to inquire into and report on the policies, implementation, prevalence, causal factors and solutions to child marriage in Sarawak.
